Placement Policy/Procedure
  1. The CAD Corporation will provide suitable applicant/s using our extensive database and advertising media. Such advertising will in no way compromise the identity of your company.
  2. All applicants CV’s will be screened and checked, interviewed and specific Autodesk skills will be tested/verified. Only once this process is complete will the applicant’s profile be published.
  3. Should applicants show interest in your available position, an email notification will be sent to us which in turn will notify you.
  4. In the event that an applicant referred to you is successful in gaining employment, our consultant will make contact with you at regular intervals so as to assess the applicant's progress and/or any other related business.
  5. Our terms and conditions of placement are set out in the Terms & Conditions page.
  6. Our fees are set out in the Placement Fees page.
  7. It should be noted that in the case of permanent placements, the candidates employment contract is with the client and not The CAD Corporation.
  8. It should be noted that in the case of temporary or managed placements, the candidates employment/service contract is with The CAD Corporation and not the client.
  9. In the case of permanent placements, invoices will be issued on a monthly basis.

Terms & Conditions of Placements
  1. Any placement resulting herefrom shall be subject to the conditions stated herein unless specifically varied by the parties in writing. In these conditions, words importing one gender shall include the other gender, words importing the singular shall include the plural (and vice versa), and words importing a natural person shall include a juristic person (and vise versa).
  2. The client acknowledges that the placement fee is payable within 7 days of the successful applicant’s date of commencement of employment with the client unless otherwise agreed. The client also acknowledges that the Annual Income (upon which the placement fee is calculated) shall be based upon the Gross Annual Salary package inclusive of travel/car allowance, housing allowance, pension, provident fund, medical aid, medical insurance, cell allowance, BUT excluding company car, company house, company cell phone, annual bonus and commission.
  3. The client is granted a 90 day guarantee, commencing on the start of the successful applicants employment with the client, in terms of which, should the applicant leave the client's employ or be dismissed for any reason (other than retrenchment, unfair dismissal or unfair labour practices) within the guarantee period, The CAD Corporation will endeavour to provide an equivalent suitable replacement. Should the client decide not to replace the applicant within the guarantee period, 50% of the total placement fee will be retained by The CAD Corporation to cover administration costs. Should payment of the placement fee not be received by The CAD Corporation within 7 days of invoice, the guarantee shall lapse and shall not be enforceable against The CAD Corporation.
  4. If any amount is not paid within the agreed time period the client shall be liable for interest at the maximum rate permitted in terms of the Usury Act, No. 73 of 1968, as amended from time to time. Such interest shall be calculated and paid monthly in advance, provided that if the interest is not paid as aforesaid, the interest shall be added to the principal sum and the whole amount shall form the principal debt which shall bear interest as aforesaid.
  5. A certificate under the hand of any member, director or manager of The CAD Corporation, whose appointment need not be proven, as to the existence and the amount of the client's indebtedness to The CAD Corporation at any time, as to the fact that such amount is due and payable, the amount of interest accrued thereon and as to any other fact, matter or thing relating to the client's indebtedness to The CAD Corporation shall be sufficient and satisfactory proof of the content and correctness thereof for the purpose of provisional sentence, summary judgement or any other proceeding of whatsoever nature against the client in any competent court and shall be valid as a liquid document for such purpose.
  6. In the event of The CAD Corporation instructing attorneys to collect from the client an amount owing to The CAD Corporation, the client agrees to pay all costs on the scale as between attorney and own client, including collection charges.
  7. The client consents to the jurisdiction of the Magistrate's Court in terms of Section 45 of the Magistrate's Court Act No. 32 of 1944 (as amended) having jurisdiction under Section 28 of the said Act, notwithstanding that the claim by The CAD Corporation exceeds the normal jurisdiction of the Magistrate's Court as to amount. The CAD Corporation shall, in its discretion, be entitled to proceed against the client in any other court of competent jurisdiction, notwithstanding the aforegoing.
  8. The client nominates as its domicilium citandi et executandi the address reflected on the reverse hereof under the heading "Address" for service upon it of all notices and process in connection with any claim or any sum due to The CAD Corporation arising out of any placement and work done on behalf of the client.
  9. No relaxation or indulgence granted to the client by The CAD Corporation, at any time, shall be deemed to be a waiver of any of The CAD Corporation rights in terms hereof, and such relaxation or indulgence shall not be deemed a novation of any of the terms and conditions set out herein, or create any estoppel against The CAD Corporation.
  10. Any agreement purporting to vary the terms of this agreement or any consensual cancellation shall not be valid unless reduced to writing and signed by both The CAD Corporation and the client.
  11. Whilst The CAD Corporation shall endevour to do everything reasonably possible to ensure that applicants are of the highest calibre, it shall not be liable to the client for any loss, damage, liability, claim, expense or penalty sustained by the client arising directly or indirectly from any act or omission by any applicant placed at the client.
  12. Should the client introduce a The CAD Corporation referred applicant to any other company, subsidiary, or associate, the client will be liable to pay the placement fee should the applicant be employed by any of the above mentioned.
  13. You undertake and warrant to notify us immediately in the event that an applicant introduced by The CAD Corporation to you is employed or taken on in whatever capacity within 12 months of the introduction being made and will at once provide us with full details of the remuneration (as defined in the General Terms and Conditions) relating to their appointment.
